What exactly is meant by domestic adoptions? Domestic adoption simply means you are adopting from your home country, rather than internationally. Domestic adoptions can be done privately, or through an adoption or foster care agency. You must be at least 25 years old and a U.S. citizen.
The big fear for prospective adoptive parents in domestic adoptions seems to be the idea of open adoptions, meaning your child may have ongoing contact with his or her birth parent(s). Open adoptions have become more common in the last ten years. Also, the waiting period for domestic adoptions through an agency, particularly for infants, can be quite long.
There are other alternatives, such as the foster care system, or taking a pro-active approach and advertising for a birthmother.
All that being said, the success stories by far outweigh the negative press you hear. Open adoptions can be healthy and successful. It is helpful to both sides to have an understanding, in writing as to the parameters that fit the comfort level for everyone involved. A skilled adoption attorney can help with all aspects of the process.

The last and final step in an adoption is the legal process which with finality completes the process. As you can imagine, all of the work and proofs must be submitted to the Court in advance of the hearing date. Assuming everything is in order, a hearing date is scheduled and the adoptive parents and child or children appear in Court for finalization of the legal process. The hearing is before a judge. The parents are sworn in and a series of questions must be answered. Assuming all the information is in accordance with our laws, the judge grants the adoption! Thereafter, it is necessary to have the birth certificate properly amended. This particular process to amend the birth certificate sometimes takes a few months. Whether to adopt domestic or international is an age old question that perplexes many a prospective adoptive parent. Of course, the stories you hear about are the horror stories:
If you go the International route you don’t know what kind of prenatal care the birth mother received. Further, is the child placed in an orphanage or a foster home? Are they nurtured as infants? Will they be able to bond with your family?
Other “issues” surrounding International adoption include that often International adoptions offer older children, and some countries have strict rules about age, marital status and health (including mental health). Most children are not infants, but range in age from 6 months to teenagers. Further, some countries require lengthy visits to the country before you can take your child home.
Many celebrities opt for International adoptions, including Madonna, Meg Ryan, Ewan McGregor, Angelina Jolie, Julie Andrews and James Caviezel to name a few.
All that being said, the success stories by far outweigh the negative press you hear. International adoption can be a wonderful experience, and you can, in many cases, literally save a child from poverty, illness or even death. The joy in International adoption is unlimited.
Keep in mind, however, that countries are constantly changing their rules, as well as opening and closing their borders to foreign adoptions. The first step in commencing the adoption process is exploring your options and learning the eligibility requirements for adoptive parents. If pursuing adoption with the assistance of an agency, it is important to research the agency’s criteria for accepting applicants. Some agencies will only consider couples married for a certain number of years, between the ages of 25 and 40, and with stable employment. However, there are other agencies that accept applicants who are older than age 40. Some agencies require that the couple have no other children. Some require that at least one parent not work outside the home for at least 6 months after the adoption. If you are considering an international adoption, every country has requirements that prospective adoptive parents must meet. These requirements vary by country and typically pertain to age, income, number of existing children in the home, some indicator of marital stability and, in the case of single applicants, gender, although, some countries have unusual eligibility requirements. For example, China has a weight restriction for prospective adoptive parents.
Adoptions can also be arranged without an agency known as a private placement adoption. Initial contacts can be made directly between a birth mother and the prospective adoptive parents. If you pursue this approach, it is important to retain an experienced adoption attorney to explain the adoption laws to you and guide you through the legal process and procedures. To initiate a private placement adoption, you must first locate a birth mother seeking an adoptive family for her child. The State of New Jersey permits advertising in the classified section of local newspapers as a method for bringing birth parents and adoptive parents together. Another way to locate a birth mother is to send an introductory letter, together with your adoption profile, which may include photos, and resume describing your family life, home, jobs, hobbies, and interests to crisis pregnancy centers or obstetricians’ offices. An experienced adoption attorney will be able to assist you in preparing your adoption profile.
After a child is placed with you either with the assistance of an agency or through private placement, you must fulfill the legal requirements for adoption. Please contact one of our experienced adoption attorneys at Iandoli & Edens, LLC at 908-879-9499 to discuss these legal requirements and to review your adoption options or visit us on the web at http://www.iandoliedens.com.
On this, the 10th anniversary of the September 11th, 2001 terrorist attacks, there is much pain in remembrance. There are also many stories of the lives of the people left behind – those who lost children, spouses, and especially of children who lost a parent. These children range in age from nine (those who were not yet born when their parent was killed) to twenty seven.
One recurring theme in these stories is that of the children whose widowed mother or father remarried in the ten years since the attacks. The tales are often heartwarming – a widow or widower of a terrible tragedy like 9/11 finding happiness again.
The children who were left motherless or fatherless often were then adopted by their stepparent. Stepparent adoptions are common in our country. The process inNew Jerseyis much like any other adoption. It gives both the parent and child the full rights and responsibilities as if the child were born to that parent.
In most cases, for a stepparent adoption to be granted, the birth parent must either be deceased, or relinquish parental rights. The child’s remaining living parent must also agree for the adoption to take place.
